The New Jersey Criminal Code contains some of the most stringent weapons laws in the nation, with a variety of extremely serious charges that entail specific sentencing guidelines outlined in the state’s “Graves Act,” the details of which are provided in N.J.S.A. 2C:43-6(c). For example, if you are found guilty of an offense such as Unlawful Possession of a Handgun, Rifle, Shotgun, or Machine Gun, or Possession of a Firearm for an Unlawful Purpose, you may be required to serve time in prison even if you have no prior criminal record.

In addition, there are certain individuals who are permanently banned from possessing a weapon in New Jersey. Those included in this category, often referred to as “Certain Persons,” are typically those who have been previously convicted of other crimes such as aggravated assault, kidnapping, or robbery. Individuals who violate State law by possessing a weapon become vulnerable to criminal charges known as “certain persons not to have weapons” offenses.
