The court has a level of discretion in determining how much the dependent spouse is going to be paid by the other. A judge will evaluate a wide range of factors, including:

  • Sacrifices made by either spouse for the advancement of the other
  • Education levels of both spouses
  • Income of both spouses
  • The division of assets and how that will affect both spouses’ lifestyles
  • Length of the marriage

Based on this, one spouse may be required to make payments to support the other’s lifestyle. This can either be for a specific period of time or indefinitely. The primary goal, however, is to get the dependent spouse to a place where he or she can be self-sufficient. That spouse must often prove to the court that he or she is making efforts in education or career.
